The Nassau County Police Department recently announced it plans to keep crime down this year throughout the county. One focus for the department will be to increase safety on the roadways, especially the well traveled highways. The department has implemented an initiative specifically to decrease aggressive driving. Officers, particularly those assigned to the Highway Patrol Bureau, will be on the look out for motorists who are speeding, using their cell phone while driving or going through red lights. Members of the police department will be writing more tickets this year than in past years in an effort to decrease dangerous driving throughout the county.<br />

Effective immediately the Nassau County Traffic & Parking Violations Agency (NCTPVA) located at 16 Cooper Street in Hempstead has changed their policy on Cell Phone and Electronic Device tickets.<br />
<br />
Under New York State Law a plea of guilty to violating Vehicle and Traffic Law Sections 1225(c) or (d), Using a Cell Phone or Electronic Device While Driving, will result in five (5) points on your New York State driver’s license. As many people are aware points on your license may lead to increased insurance premiums. If you receive six or more points on your license you may also be subject to the Driver Responsibility Assessment Fee imposed by the DMV.<br />
<br />
In the past the NCTPVA has been very reasonable in plea-bargaining Cell Phone and Electronic Device tickets. Depending on your driving record such tickets have had the possibility of being reduced to three (3) or less point violations.<br />
<br />
However that plea-bargaining leniency has changed with the Court’s newly announced Distracted Driver Education Program. Under this initiative a motorist must admit to Improper Use of a Cell Phone or Electronic Device and waive their right to appeal. They will then be allowed to plead to Tailgating, a four (4) point violation, and must pay a $283.00 fine. The motorist is then required to purchase and install in their car an approved cell phone control device within 10 days. The device will monitor whether the person operates an electronic device while driving in violation of the law. This device must remain in the motorist’s vehicle for 90 days. On the next court date, the motorist must provide the Court with a print out of the report generated by the device. The Court will then determine whether the motorist has complied with the terms of the agreement. If so, the motorist will be allowed to vacate their plea to Tailgating and instead plea guilty to a no point Parking ticket. If the motorist fails to comply with the conditions of the program then their plea to Tailgating will remain on their driving record.<br />
<br />
If this program sounds onerous and excessive for a simple traffic ticket it’s because it is. But if you go to the NCTPVA to fight a Cell Phone or Electronic Device ticket it is the only offer that the prosecutor is authorized to make you.<br />

However, there is still another way to fight a Cell Phone or Electronic Device ticket at the NCTPVA. Hire an experienced attorney who is familiar with the appropriate discovery demands and motions that can be made on such tickets.<br />

On February 11, 2016, a Nassau County jury found 28-year-old James Ryan guilty of Manslaughter and Aggravated Criminally Negligent Homicide, among other charges.<br />
<br />
Ryan allegedly had a blood-alcohol level of 0.13 when he was driving home on the Long Island Expressway almost four years ago and crashed his car. He fled that accident scene only to crash his car again further down the road. Officer Olivieri of the Nassau County Police Department responded to the scene and was killed when the driver of another vehicle hit into him. No criminal charges were brought against that driver.<br />
<br />
The death of Officer Olivieri is a tragic loss for his family, the police department and the citizens of Nassau County whom he protected. There is no denying that. However I believe that the verdict in the case against James Ryan is wrong. Yes, Ryan was drunk driving on October 18, 2012 and yes, that is a crime. Should he have been found guilty of Driving While Intoxicated? Absolutely. But should he have been found guilty for the death of Officer Olivieri? No. It is my opinion that the death of Officer Olivieri is too far attenuated from Ryan’s drinking and driving to have found him guilty of homicide. The person at fault for the officer’s death is the other driver. The other driver clearly wasn’t paying enough attention while driving on the Long Island Expressway that night because if he had been he should have seen Olivieri’s police vehicle, as well as Ryan’s damaged vehicle before coming up the scene and striking the officer. That’s not to say that his actions make him criminally liable for the officer’s death, but neither do Ryan’s actions.<br />
<br />
The Nassau County District Attorney’s Office has a history of pushing the limits and setting precedents in DWI cases. They are one of the toughest, if not the toughest county in New York State in their plea bargaining guidelines for DWI cases. The Nassau County District Attorney’s Office was one of the first in the country to successfully convict a DWI driver of murder. The office made national headlines in 2006 in the case against Martin Heidgen when a jury appropriately found Heidgen guilty of two counts of depraved indifference murder after slamming his truck into a limousine and killing a seven year old passenger and the limo driver.<br />
<br />
While I commend the District Attorney’s Office for taking a hard stance against DWI cases giving its prevalence on Long Island, I think they went too far in the case against James Ryan. This verdict sets a dangerous precedent for future cases. Imagine the following scenario: An officer pulls a motorist over for speeding on the Long Island Expressway. The motorist pulls over to the side of the road but to an area where there is barely a shoulder. As the officer walks towards the pulled over vehicle, another car drives by and strikes the officer. Is that speeding motorist liable for the death of the officer? The verdict in the Ryan case seems to indicate that he would be. Both DWI and Speeding are against the law and in the Ryan case and in my hypothetical an officer was killed as a result of investigating the crime. So where do you draw the line? This recent verdict has the potential to lead to a very slippery slope.<br />
<br />
I am sure that Ryan will appeal the verdict in his case and I am very interested to see what the outcome will be.<br />

These cameras are in addition to the red light cameras that have been installed over the past several years in both Nassau and Suffolk Counties. While there are no points added to the license of the owner of the vehicle which allegedly went through the red light or sped through the speed zone, the fines generated by these violations are real and add up. As of the time of this writing September 25th, 2014 the fine for a violation of either offense is $50.00 plus a $30.00 Driver Safety Fee for a total of $80.00 per ticket. Often times the owner of the vehicle is not even the driver at the time of the offense was committed, and is unaware the ticket was even issued until several days down the road when a bill comes in the mail. The letter sent by the County or its representative includes a link so that you can view the infraction on your computer and watch the vehicle as it goes through the red light or speed zone.<br />
<br />
While many assert that these cameras promote safe driving I believe that they are simply money makers that punish the driving public. I believe that often times the cameras can cause accidents by forcing motorists to slam on their brakes at the last minute thereby causing rear end accidents.<br />
<br />

On June 11th, 2012 shorty after the Nassau County District Court opened for the day a verdict was rendered after a two day bench trial in criminal part 6. The charges against the defendant were as follows:<div>

<li>Aggravated Unlicensed Operation (Criminal Charge - Misdemeanor)</li>
<li>Speeding in a School Zone</li>
<li>Tinted Windows</li>
<li>Unlicensed Operator</li>
</ul>

The verdict as announced by the Court:</div>

<li>Not Guilty - Aggravated Unlicensed Operation</li>
<li>Not Guilty - Speeding in a School Zone</li>
<li>Not Guilty - Tinted Windows</li>
<li>Guilty - Unlicensed Operator</li>

For the Defendant it was a great verdict as he was not convicted of the criminal offense of Aggravated Unlicensed Operation (§511.1) which could carry with it a possible sentence of jail in the Nassau County Correctional Facility. In addition the moving violation of Speeding in a School Zone (§1180C) which carried with it many points and increased fines was dismissed, thus preventing an anticipated major impacting on the Defendants auto insurance premiums. </div>

The only charge the Defendant was convicted of was the violation, not a crime, of operating without a license. The fine imposed was minimal and the Defendant walked from the building with a smile on his face. </div>

In
New York State, a person can be charged with Driving While Intoxicated pursuant
to section 1192.2<a href="http://www.blogger.com/blogger.g?blogID=775349665096637799#_ftn1" name="_ftnref" title=""><span class="MsoFootnoteReference"><!--[if !supportFootnotes]-->[1]<!--[endif]--></span></a> of the
Vehicle and Traffic Law if they operate a motor vehicle while having .08% or
more of alcohol in their blood as shown by chemical analysis of their blood,
breath, urine or saliva.</div>

<div class="MsoNormal" style="text-align: justify;">
Breath
testing is based upon the correlation between the amount of alcohol in a
person’s breath and blood, and the ability to measure that amount accurately
for each individual. In order to convert the breath sample into a blood alcohol
percentage, all machines utilize a “Breath to Blood Partition Ratio” of 2100 to
1. This partition ratio essentially
states that the amount of alcohol in one milliliter of blood is 2100 times
greater than the amount of alcohol in 1 cubic centimeter of expelled breath.</div>
<div class="MsoNormal" style="text-align: justify;">

<div class="MsoNormal" style="text-align: justify;">
The
problem with the 2100 to 1 breath to blood partition ratio used by breath
testing instruments is that it does not take into account individual ratios,
but rather assumes that everyone has the same partition ratio. Studies have proven that individual
breath to blood partition ratios vary among individuals with a range of
approximately 1000 to 1 –to- 3000 to 1.
What is even more troubling is that the breath to blood partition ratio
varies within individuals depending upon which phase of alcohol absorption they
are in.</div>
<div class="MsoNormal" style="text-align: justify;">

<div class="MsoNormal" style="text-align: justify;">
Studies
have shown that in the absorptive phase of alcohol digestion, the breath to
blood partition ratio is often less than the standard 2100 to 1 figure.
Therefore, if you were apply the standard 2100 to 1 breath to blood partition
ratio during this phase, it would result in a false high reading. For instance, if an individual
submitted to a chemical test that resulted in a reading of 0.10% and the
individual had a breath to blood partition ration of 1000 to 1, the actual
blood alcohol percent would be .05%.
A person who operates a motor vehicle with a blood alcohol level of .05%
is not intoxicated and cannot be charged with Driving While Intoxicated. Conversely, if a person’s breath to
blood partition ration is greater then 2100 to 1 the actual concentration of
alcohol in their blood would be underestimated if the standard breath to blood
partition ratio is used.</div>

So
where does all of this leave us? It leaves us guessing as to a person’s true
alcohol to blood concentration. The
solution to this guessing game is a blood test. The only accurate way to
measure the concentration of alcohol in someone’s blood is to test the person’s
blood. Hospitals test blood everyday,
all day long, and the police have the ability to take and test blood as
well. In fact, the police have
special blood testing kits that come with instruction cards for drawing and
preserving blood for alcohol testing. When a person’s life, liberty and reputation are on the line,
we believe that the most accurate testing available should and must be used,
and the use of anything less is an injustice.</div>

Breath
testing equipment has been utilized by police departments since the early
1970’s and has been deemed reliable for courts since that time. And yet, the science underlying the
equipment still has not been perfected. As I’ve already mentioned, the
equipment uses a presumption about an individual’s breath to blood partition
ratio, which, depending on the individual and/or the phase of alcohol
digestion, may not be accurate. In
addition to that, CMI, Inc., the manufacturer of the Intoxilyzer series of
machines utilized by the Nassau and Suffolk police departments, currently has twenty-four
(24) versions of its Intoxilyzer series listed on the New York State Breath

purported to be, then why do twenty-four (24) different versions of the machine
exist? Why isn’t one standard
machine used? </div>

The
answer is simple. Breath testing
has not been perfected, and the companies that manufacture the breath testing
machines are continuously trying to discover new ways to improve them. Imagine convicting a person of the
crime of Driving While Intoxicated based on the results of the breath machine
which indicated that the person was intoxicated, only to find out that a more
accurate version of the machine was introduced a week after the person had
submitted to the test. Given the
very real reality of that situation, we cannot conceive of relying on a machine
that is constantly being replaced and updated by new and improved versions when
it comes to determining a person’s freedom. </div>

the breath testing equipment have still not discovered ways to address the

machines use infrared analysis to test for alcohol in the breath, but the infrared
wave-lengths that are used test for the methyle group, rather than for the alcohol
specific ethyl molecule. Therefore, if a person has a methyle compound in his
system, the breath-testing machine will detect alcohol even though the subject
has no alcohol in his system. This can occur when a person is exposed to
certain paints or wood stains in addition to other compounds that contain
molecules in the methyl group.</div>

breath sample is even 1 degree above 34 degrees Celsius, it will produce a reading
that is approximately 7% higher than his actual reading. Despite this fact, the
breath testing machines do not have safeguards to test the temperature of a
person’s breath sample and the police do not check a person’s temperature
before a breath test is administered.</div>

As can be seen from the above
trusting Breath Testing Devices can result in false convictions. It is my
opinion that only a blood test will accurately indicated what a person’s true
blood alcohol content is. </div>

late 2012 a client of mine was charged with a DWI with a fatality. The police
indicated that my client had <b><u>Red Glassy Eyes</u></b> and the <b><u>Odor
of an Alcoholic Beverage</u></b> on his breath. Three SFT (Standard Field
Sobriety) test were administered to the Defendant; the <b><u>Finger to Nose</u></b>,
<b><u>Standing at Attention</u></b>, and the <b><u>Nine Step Walk and Turn</u></b>.
The police claim that positive clues for intoxication resulted from these test.
The Defendant also agreed to take a PBT (breath test) which allegedly showed
alcohol in his system. The Defendant was arrested and brought for blood testing
immediately thereafter. The results of two separate laboratories testing the
blood? No alcohol or drugs in the Defendant's blood. That bears repeating. Zero
alcohol in the Defendant's blood. <o:p></o:p></span></div>

<span style="font-size: 16.0pt; mso-bidi-font-family: Times;">As
a result of the blood testing done by the Nassau University Medical Center all
charges against the Defendant were dismissed by the Nassau County District
Attorney's Office. <o:p></o:p></span></div>

<span style="font-size: 16.0pt; mso-bidi-font-family: Times;">So
the question remains. How is it possible for a Nassau County Police Officer to
swear that the Defendant had all the signs of intoxication, yet have no alcohol
in his system?<o:p></o:p></span></div>

<span style="font-size: 16.0pt; mso-bidi-font-family: Times;">Was
the officer mistaken, lying, looking for overtime? I don't know the answer,
perhaps we will never know. But what we do know is that just because a Police
Officer indicates that a person has Glassy Bloodshot Eyes, the Odor of an
Alcoholic Beverage on their Breath, and claims clues of intoxication from Stand
Field Sobriety Testing, that doesn't mean that the person (Defendant) was
actually intoxicated. In fact in some cases the Police are 100% wrong, despite
the fact that they are trained to detected intoxicated drivers. <o:p></o:p></span></div>

of the NYS VTL, §1180 is titled "Speed Restrictions" and it outlines
the various speeding offenses that can be committed. There are seven
subsections to §1180 of the VTL; 1180(a), 1180(b), 1180(c), 1180(d), 1180(e),
1180(f) and 1180(g). If you are stopped by a police officer in Nassau, Suffolk,
Queens or any other county throughout the state of New York and receive a
speeding ticket, it will be charged under one of the above sections. Each of
the speeding subsections (a) through (g) will be explained in detail below. As
will section §1181, Driving too Slowly and section §1182, Speed Contest. The explanations
will include point, fine, surcharges and possible jail sentences.<o:p></o:p></span></span></div>

go into the specifics of each subsection to section §1180 of the NYS VTL there
are some general rules that every motorist should know.<o:p></o:p></span></span></div>

<span style="font-family: Verdana;"><span class="Apple-style-span" style="color: white;">The
"Three Speeds Rule" provides that if a motorist is convicted of any
three traffic citations under section 1180 within an eighteen (18) month period
of time the Court must REVOKE your license pursuant to Section §510.2(iv) of
the NYS VTL. Section §510.2(iv) is titled Suspension, revocation and reissuance
of licenses and registrations. Under this provision the revocation of your
driver's license is mandatory. Therefore, if a motorist were to receive and be
convicted of three traffic tickets within any 18 month period of time under any
sections of §1180 his or her license must be revoked. Even if the Judge or
Hearing Examiner did not want to impose a revocation based upon a third
conviction they would have absolutely no choice. To sum it up, the first rule
is: Three (3) speeding ticket convictions within any eighteen (18) month period
of time = mandatory revocation of your drivers license.<o:p></o:p></span></span></div>

<span style="font-family: Verdana;"><span class="Apple-style-span" style="color: white;">Another
rule that every motorist who operates a vehicle in New York should know is that
all moving violations will result in points on your license if you are
convicted for the violation alleged. Excessive points can result in the
suspension or revocation of your New York State Driver's License and/or your
New York State driving privileges and Driver’s Responsibility Act liability.
The suspension under the excessive points rule is for motorist who are
considered persistent violators. The NYS DMV will generally issue a suspension
when a motorist receives more then ten points on his or her driving record
within any eighteen (18) month
period of time. A motorist who is notified about an upcoming suspension that is
permissive has the right to request a hearing so that they may be heard under
NYS VTL §510.3(a).<o:p></o:p></span></span></div>

Responsibility Assessment Act is a program that applies to all drivers who
operate or who operated a motor vehicle in the State of New York. Essentially
the Act punishes a motorist who has too many points on his or her license by
assessing a yearly fine for the excessive points. This yearly fine lasts for
three (3) years and is in addition to any fines, fees, penalties, or surcharges
that are paid for the ticket itself. The Assessment is triggered when a
motorist receives 6 or more points on his or her license within any eighteen
(18) month period of time. The initial fine on the first six (6) points is ONE
HUNDRED DOLLARS ($100.00) per year for three years, and an additional twenty
five dollars ($25.00) for each point over six (6) for that same time period. Failure to pay the assessment will
result in the suspension of your New York State driving privilege <o:p></o:p></span></span></div>

subsection deals with situations where a motorist can be given a ticket even
though he or she is not driving above the posted speed limit. How can a police
officer issue a summons for speeding when the driver is not exceeding the limit
you ask? Well, did you ever drive down the road in a snow storm and witness an
SUV passing you at 40 miles per hour despite the fact that you could barely see
past your windshield and your own speed was only 15 mile per hour. Under those
circumstances an officer would be totally justified in issuing a speeding
summons for operating a vehicle at a speed that is greater than reasonable and
prudent under the conditions at the time. <o:p></o:p></span></span></div>

subsection deals with speeding in excess of the statewide speed limit of 55
miles per hour. Unless a roadway has an established posted speed limit in
excess of 55 miles per hour, (like certain portions of the NYS Thruway) a
motorist may not exceed 55 miles per hour. This section of §1180 is taken so
seriously by the New York State Department of Motor Vehicles that it is
referenced under section §510(a)(4). <o:p></o:p></span></span></div>
<div class="MsoNormal">
<span style="font-family: Verdana;"><span class="Apple-style-span" style="color: white;">What is
section §510(a)(4) you ask? Well, if you have a CDL otherwise known as a
commercial driver's license then Section §510(a)(4) is something you should
know about. This section of the NYS VTL lists the infractions that are
considered a SERIOUS TRAFFIC VIOLATION. Why is it important to know what a
SERIOUS TRAFFIC VIOLATION is? Because, if you are convicted of two SERIOUS
TRAFFIC VIOLATIONS within any three (3) year period your CDL license will be
suspended for a period of sixty (60) days. And if you catch a third SERIOUS
TRAFFIC VIOLATION within that same time period you can double the suspension to
one hundred twenty days (120).<o:p></o:p></span></span></div>

catch? The catch is that depending upon the day and time of the traffic
infraction the fine doubles (See below). So if you are issued a speeding ticket
in a school zone, on a date in which school is in session, between the hours of
7 AM and 6 PM, your fines will be doubled. However, the good thing is that your
points are not doubled. If you possess a commercial driver’s license a
conviction to this section of §1180 is considered a SERIOUS TRAFFIC VIOLATION.

section of §1180 prohibits unauthorized races on the public roadways. If you
have seen movies like the Fast and the Furious you know what street racing is. <o:p></o:p></span></span></div>

no points assessed against your license if you are convicted of street racing,
rather your license is simply revoked. <o:p></o:p></span></span></div>

<div class="MsoNormal">

for a violation of this section depends upon how many times the motorist has

the first conviction the fine range is between $300 and $525.00.<o:p></o:p></span></span></div>

If you are asked to exit the vehicle, there is an extremely high likelihood that the officer has already determined to arrest you for DWI. On the side of the road there is no fair judge of your performance and there is no video of how you perform. The only judge of your performance is a police officer who often times is going to make overtime based upon your arrest. </div>

You have the right to refuse standardized field sobriety tests. If any of the above conditions are present it can have a major impact on the results of the testing which will then be used against you in court. Keep in mind that at this point in the stop you are likely to be arrested. The question is whether performing standard filed sobriety test in the field (on the road) will help exonerate you, often times they will not no matter how well you really perform. People fail sobriety tests when they are sober. Sobriety tests are subjective tests unless they are recorded with audio and video so that they can be judged fairly by others. With all the factors that can affect DWI sobriety tests on the roadside it is often better to refuse all testing.</div>

3.<span class="Apple-tab-span" style="white-space: pre;"> </span><b><u>Breath Testing</u></b>. Every motorist who is arrested and charged with a DWI in New York, is required to submit to a chemical test of their blood, breath or urine to determine their alleged blood alcohol concentration or BAC. Though a person has the right to refuse this testing (and often times should), a knowing refusal will result in the revocation of their driver’s license for a one year period if proper refusal warnings are given by the officer. The question then becomes do you give a breath sample. </div>

•<span class="Apple-tab-span" style="white-space: pre;"> </span>The Nassau County Crime Lab was closed in early 2011 because of departures from the minimum standards of care necessary to run a police crime lab. The crime lab was responsible for mixing the simulator solutions that the breath testing equipment in Nassau County utilizes. </div>
<div style="color: #ffeedd; font-family: Arial, Tahoma, Helvetica, FreeSans, sans-serif; font-size: 14px; line-height: 20px; text-align: justify;">
•<span class="Apple-tab-span" style="white-space: pre;"> </span>Kathleen Rice, the Nassau County District Attorney pointed out at a morning news conference that she asked county executive Mangano to shut the lab down "because supervisory activity and potentially intentional personnel conduct relate not only to the drug chemistry testing performed at the lab but to the entirety of the lab."</div>
<div style="color: #ffeedd; font-family: Arial, Tahoma, Helvetica, FreeSans, sans-serif; font-size: 14px; line-height: 20px; text-align: justify;">
•<span class="Apple-tab-span" style="white-space: pre;"> </span>In Nassau County it is police policy that no video will be made of your performance tests (Standardized Field Sobriety Tests) if you take a breath test. In other words if you want to have a video made of your testing so that your performance can be judged by a neutral person (a jury) rather then a police officer you must refuse a breath test. Essentially, if you want a video made to show your innocence you must give up your driver’s license!! That is ridiculous and unfair.</div>
<div style="color: #ffeedd; font-family: Arial, Tahoma, Helvetica, FreeSans, sans-serif; font-size: 14px; line-height: 20px; text-align: justify;">
•<span class="Apple-tab-span" style="white-space: pre;"> </span>Breath testing equipment is not perfect and it can make mistakes.</div>

o<span class="Apple-tab-span" style="white-space: pre;"> </span>If the persons blood to breath partition ratio deviates from the median it can throw off the machine, not everyone is in the middle of a bell curve. </div>

o<span class="Apple-tab-span" style="white-space: pre;"> </span>There police do not wait 10 - 15 minutes and then perform a second test to confirm the results of the first test. Unfortunately if you believe the machine has made a mistake and request a second test you will be denied.</div>

Juries often are kept in the dark about just how many things can go wrong with a breath testing machine despite the best efforts of the defense attorney. Deciding whether to take the breath test or not is a case specific decision, and often times the best decision is not to take the test, especially if you do not trust the police.</div>

4.<span class="Apple-tab-span" style="white-space: pre;"> </span><u><b>S</b></u><b><u>tandardized Field Sobriety Testing (SFST)</u></b>. In Nassau County, Suffolk County and Queens County the decision to take SFST back at the station is a hard one. Often times you are being pressured to take tests that are not properly explained under conditions that would make anyone uncomfortable. As mentioned above in Nassau County DWI testing is not video taped unless you are willing to give up your license for a year! However, if you want the best evidence of your testing preserved you must refuse the breath test or no audio/video will be made. </div>

SFST testing is not an exact science and the results reported can vary on the same subject depending on who gives the test. All of the issues that can impact the roadside SFST testing listed above are present but add to that the pressure and nervousness of having been placed in handcuffs and told you are under arrest for the first time in your life. Under those conditions only you can decide if taking the tests would be fair and accurate. I believe that for the average person it is better to refuse the test as they are typically administered in an unfair and coercive manner. </div>

A person obtains property by false promise when, pursuant to a scheme to defraud, he obtains property of another by means of a representation, express or implied, that he or a third person will in the future engage in particular conduct, and when he does not intend to engage in such conduct or, as the case may be, does not believe that the third person intends to engage in such conduct. In any prosecution for larceny based upon a false promise, the defendant's intention or belief that the promise would not be performed may not be established by or inferred from the fact alone that such promise was not performed.
